Terms and Conditions
These Terms and Conditions cover Uswim events including Team Relays in 2016 which are organised by Uswim Ltd. Please read them carefully prior to registering for an event and/re Team Relay. You should only register and enter an event and/or Team Relays if you have read, understood and agreed with these conditions. These conditions represent a legally binding agreement between you and Uswim Ltd.
The events and/or Team Relays are organised by Uswim Ltd whose registered office is 138 Rosebery Street, Manchester, M14 4UX and whose company number is 07111061. If you have any questions about these terms please contact us at email@example.com
The Organiser shall not be liable for any loss, death, injury or damage however caused to any person or property, except where such loss, death, injury or damage is a result of the negligent acts or omissions of the organiser. Any claim to which legal liability is established shall not include damages for indirect or consequential loss.
You acknowledge that participation in open water swimming events and/or Team Relays involves the real risk of serious injury or death from various causes including exertion, strenuous activity.
The events and/or Team Relays will be physically demanding and you are aware of the associated medical and physical risks involved. You accept that you are physically capable of competing in the events and/or Team Relays and agree that, subject to the limitation of liability paragraph below, Uswim Ltd, its officers, agents, affiliates, sponsors or medical advisers are not responsible for any injury or illness that you may suffer as a result of your participation in the events and/or Team Relays. The entrant accepts that should any medical or physical condition arise prior to the events and/or Team Relays which is likely to affect their ability to compete then the entrant will withdraw in accordance with these terms and conditions.
You will inform us of any medical conditions from which you suffer. You give permission to our Event staff and medical support to make decisions regarding your medical care and treatment and, where necessary, to authorise such care and treatment in emergency situations. You understand that our event staff will make every reasonable effort to reach your emergency medical contact you have supplied, however you hereby give permission to the medical professional whose services might be required to provide medical care and treatment.
All necessary race information for the event will be published on the event web site. Specific and detailed information related to Team Relays will be sent to participants throughout the duration of the Team Relays. Updated details of any alterations to race information will be made available on the web no later than 7 days prior to the event. It is the responsibility of the entrant to ensure they have accessed the relevant information on–line. No information on regular events will be sent through the post. It is your responsibility to ensure you have provided us with a valid e-mail and we recommend storing our e-mail in Outlook to prevent important e-mails going to 'junk'.
You further acknowledge and understand that compulsory insurance effected for the event may not cover you for any or any injury, loss or damage sustained by you. You are strongly advised to obtain personal accident and personal items coverage, adequate for the event.
Withdrawal or Cancellations
Entries to events are electronic with entry to Relay Teams secured by bank transfer.
You may withdraw from an event or Team Relay at any time, subject to the provisions of this clause. If you withdraw more than 90 days before an event you will receive a full refund less a £30 administration charge. Note that, for Team Relays, due to the large initial set up costs involved, deposits are non-refundable.
If you withdraw less than 90 days before the event you will receive no refund but we will guarantee you entry for a similar event in 2017 less a £20 administration charge with you needing to complete a new online entry. This 'less than 90 day' withdrawal clause does not extend to Team Relay participants for whom Uswim reserves the right to retain any monies paid by swimmers to date if agreed payment deadlines are not met within 5 working days of the advertised deadline passing.
In the event of poor weather conditions causing cancellation of the event or Relay swim on the advice of local professionals i.e. dangerously strong winds on the day competitors will not be eligible for refunds.
If you withdraw less than 28 days before an event you will not be able to claim a refund under any circumstances due to the events financial commitments already being made which include staffing, venue hire, medals, trophies, medals etc. Unlike the 90 day clause above you will not be offered a free entry into a 2017 event.
Should we require to change the date of the event and/or Team Relay, you will have 14 days to notify us of your withdrawal from the event and/or Team Relay and receive a refund but thereafter will be held to the above terms.
The entry to the race and/or Team Relay is not transferable to another individual.
Publicity and Results
You irrevocably consent to your appearance being filmed, recorded on any media of whatever nature, and consent to your name, appearance, photograph being used for the purposes of promoting the event and to the commercial rights relating to the event.
We reserve the right to change these terms and conditions.
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and any disputes will be decided only by the English courts.
These conditions constitute the entire agreement and supersede any previous agreement between you and the organiser. You acknowledge by completing the entry form you cannot rely on any statement or representation or assurance however made by any person other than as laid out in this agreement.
If any of these conditions shall be deemed unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these conditions, shall be enforced to the fullest extent allowed by law as to the effect the intentions of the parties, and shall not affect the validity of any remaining conditions.
The terms and conditions do not affect your statutory rights.
